1. Agreement to Terms
These Terms of Service govern your use of hunka.io and any services provided by Hunka LLC (“Hunka,” “we,” “us,” or “our”). By accessing our website or engaging our services, you agree to these terms.
2. Services
Hunka provides white-label digital delivery services including CRM implementation, AI solutions, web development, mobile app development, SEO, and paid marketing services, all delivered on behalf of agency partners under the agency's brand.
3. Agency Partner Relationship
Hunka works exclusively with agencies and consultants (“Agency Partners”), not directly with end clients. By engaging Hunka:
- ●You confirm you are an authorised representative of the agency engaging our services
- ●You take responsibility for scoping and selling the project to your end client
- ●You agree that Hunka's deliverables are provided to you, not directly to your end client
- ●You are responsible for the final review and approval of all deliverables before presenting them to your client
4. Scope of Work
All projects begin with a written scope document agreed by both parties. Work begins only after scope approval. Hunka will not begin work without a confirmed scope.
Changes to scope during a project may affect timeline and cost. Scope changes must be agreed in writing before additional work proceeds.
5. Payment Terms
One-time project builds under $2,000: invoiced on delivery, payable within 14 days.
One-time project builds over $2,000: 50% on scope approval, 50% on delivery, unless otherwise agreed in writing.
Monthly retainers: invoiced monthly, payable within 14 days of invoice date.
6. Money-Back Guarantee
The 14-day money-back guarantee applies to the first billing period of a monthly retainer only. Refund requests must be submitted within 14 days of the first invoice date. Refunds are not available after the first billing period.
Post-pay on one-time builds means Hunka invoices on delivery. Payment is due within 14 days of invoice. This is not a guarantee of free work. It is a payment timing arrangement.
7. Confidentiality and NDA
Hunka treats all client and project information as confidential. Hunka will sign a Non-Disclosure Agreement (NDA) on request before any project begins.
Hunka will not contact your end clients directly or disclose its involvement in any project to your end clients without your explicit written permission.
8. Intellectual Property
Upon full payment, all deliverables become the property of the Agency Partner. Hunka retains no rights to deliverables after payment is received.
Hunka retains ownership of any pre-existing tools, templates, or frameworks used in delivery. These are licensed to the Agency Partner for use in the delivered project.
9. Revisions
Revision cycles are included in all project builds and retainer tiers. Revisions apply to changes within the agreed scope. Work outside the agreed scope is treated as a new request and may be scoped and priced separately.
10. Limitation of Liability
Hunka's liability is limited to the amount paid for the specific project or retainer period in which the issue arose. Hunka is not liable for indirect, consequential, or incidental damages.
Hunka is not responsible for the performance of third-party platforms (GoHighLevel, Zoho, HubSpot, etc.) or for changes those platforms make after delivery is complete.
11. Termination
Either party may terminate a monthly retainer with 30 days written notice. One-time project agreements may not be terminated once work has begun unless both parties agree in writing.
12. Governing Law
These terms are governed by the laws of the State of Georgia, United States. Any disputes will be resolved in the courts of Georgia.
13. Changes to Terms
We may update these terms from time to time. Continued use of our services after changes constitutes acceptance of the new terms.
